Operator insurance


OBLIGATIORY INSURANCE OF AIRCRAFT OPERATORS 

Pursuant to Regulation (EC) 785/2004, aircraft operator shall be insured for each individual flight as regards their liability with respect to passengers, luggage, cargo and third parties, where insured risks should include the risks of war and terrorism. 

Together with the application for the issuance of a Certificate of Airworthiness (CofA), Airworthiness Review Certificate (ARC) or Permit to fly, operator should enclose a valid certificate or other evidence of valid insurance for the aircraft in question. 

Upon request of the Croatian Civil Aviation Agency operator should present a valid certificate or other evidence of insurance, otherwise the Agency may, in accordance with the provisions of the Law on Compulsory Insurance in Traffic initiate misdemeanour procedure. 

 

INSURANCE CERTIFICATE CONTENT 

The insurance certificate or other evidence of insurance shall contain:

 

- a statement that the insurance is compliant with the insurance requirements set in Regulation 785/2004,

- aviation-specific liability in respect of passengers, baggage, cargo and third parties. 

In case the aircraft is temporarily registered in Croatian Register of Civil Aircraft based on Permit to Fly, the certificate or other evidence of insurance should contain statement that the insurance in question covers the technical flight of the aircraft from point A to point B, which will be performed based on the Permit to fly issued by the Croatian Civil Aviation Agency.

 

 INSURANCE COMPANIES

 In accordance with the provisions of the Insurance Act, in case the aircraft is registered in the Croatian Register of Civil Aircraft operator can be insured with an insurance company from another EU member state only if such company is notified with HANFA. Agents and brokers for insurance and reinsurance from another EU member state should also be notified with HANFA for providing these services in the territory of the Republic of Croatia.
